Terms and Conditions for Whakatane Appliance Repair
By using our services, you acknowledge that you have read, understood, and agreed to be bound by these terms and conditions.
1. Service Agreement:
1.1 Service Scope: We agree to provide appliance repair services for the specified appliances ("Appliances") as requested by you. The services may include, but are not limited to, diagnosing, troubleshooting, and repairing faulty appliances.
1.2 Customer Cooperation: You agree to provide accurate and complete information about the Appliances and any issues or concerns related to their functioning. You also agree to cooperate with our technicians and provide them with access to the Appliances and any necessary tools or equipment required for the completion of the repair service.
2. Service Fee and Payment:
2.1 Service Fee: The service fee for appliance repairs will be communicated to you prior to the commencement of any repair work. The fee may vary depending on the complexity of the repair, the type of Appliance, and any additional services required.
2.2 Payment: Payment for the repair services is due within seven days of being invoiced, unless otherwise agreed upon in writing. We accept payment in the form of cash, bank deposit or any other payment method specified by us.
2.3 Additional Costs: In some cases, additional costs may arise during the repair process if unforeseen issues or necessary replacement parts are discovered. We will inform you of any additional costs before proceeding with the repair. Any additional costs incurred will be added to the final invoice.
3. Warranty:
3.1 Warranty Coverage: We provide a warranty for the labor for a specified period, as communicated to you during the repair process. The warranty period may vary depending on the type of repair or replacement conducted. The warranty covers the specific repairs conducted by us.
3.2 Warranty Limitations: The warranty does not cover any pre-existing or unrelated issues with the Appliances that may arise during or after the repair process. The warranty will also be void if the Appliances are tampered with, repaired, or modified by any party other than us without our prior written consent.
4. Limitation of Liability:
4.1 Exclusion of Consequential Damages: We shall not be held liable for any indirect, incidental, special, or consequential damages arising from the use or inability to use the Appliances after repairs, including but not limited to personal injury, property damage, or financial losses.
4.2 Pre-existing or Unrelated Issues: We shall not be responsible for any pre-existing or unrelated issues with the Appliances that may arise during or after the repair process. Our liability is limited to the repair work conducted by us and does not extend to any other issues or subsequent damages.
5. Customer Responsibilities:
5.1 Access and Safety: You are responsible for providing access to the Appliances and ensuring a safe working environment for our technicians during the repair process. This includes removing any obstacles or hazards that may impede the repair work or pose a risk to our technicians.
5.2 Accurate Information: You agree to provide accurate and complete information regarding the Appliances and any relevant issues or concerns. This information is crucial for us to diagnose and address the specific problems effectively.
5.3 Proper Use and Maintenance: You are responsible for the proper use and maintenance of the Appliances following the repair service. Failure to follow the manufacturer's instructions or neglecting proper maintenance may void any warranty and result in additional issues.
6. Cancellation and Rescheduling:
6.1 Cancellation: If you need to cancel a repair appointment, you must provide us with reasonable notice. Failure to do so may result in a cancellation fee to compensate for any lost time or resources.
6.2 Rescheduling: If you need to reschedule a repair appointment, we will make reasonable efforts to accommodate your request. However, rescheduling is subject to technician availability and may incur additional costs or delays.
7. Termination:
7.1 Termination by Either Party: Either party may terminate the service agreement at any time for any reason by providing written notice to the other party. Termination does not affect any rights or obligations that have already arisen prior to the termination.
7.2 Termination Due to Non-payment: In the event of non-payment or failure to fulfill your payment obligations, we reserve the right to suspend or terminate the provision of repair services until payment is made in full.
8. Governing Law and Jurisdiction:
8.1 Governing Law: This Agreement shall be governed by and construed in accordance with the laws of [Jurisdiction]. Any disputes arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of [Jurisdiction].
8.2 Severability: If any provision of this Agreement is found to be invalid, illegal, or unenforce.
